1. Acceptance of Terms

By accessing or using the Infinite Offers website and platform (“Platform”), including submitting a “Get Your Offer” or “List Your Property” form, browsing listings, placing or receiving bids, or using any related services, you agree to be bound by these Terms of Use. If you do not agree, do not use the Platform. These terms apply in Canada and are governed by the laws of the province or territory in which you reside or in which the property is located, and the federal laws of Canada applicable therein.

2. Description of Service

Infinite Offers provides an online platform that connects residential real estate sellers and buyers. We facilitate anonymous listings and anonymous bidding, provide information about potential offers and savings (including our 1% commission model versus traditional agent commissions), and may connect users with trusted third-party vendors (e.g., lawyers, inspectors, mortgage brokers). We do not act as a real estate broker or salesperson in the traditional sense; we provide a technology platform and related services. All real estate transactions remain between the parties; Infinite Offers does not guarantee any offer, sale, or purchase.

3. Get Your Offer and List Your Property

When you submit a “Get Your Offer” or “List Your Property” form, you agree that we may contact you by email or phone regarding your request. Any indication of interest, ballpark figure, or follow-up communication from Infinite Offers or our partners is for informational purposes only and does not constitute a binding offer to buy or list your property. No obligation is created until you and the other party enter into a separate written agreement. You represent that the information you provide is accurate and that you have the authority to submit the request (e.g., as owner or authorized representative).

4. Anonymous Bidding and Listings

Our Platform allows anonymous listing and anonymous bidding. Your identity is kept confidential until a bid is accepted, as described in our service. You agree to use this feature in good faith and not to misuse it to circumvent the Platform, harass others, or violate any law. Bids and listings may be subject to additional terms (e.g., binding periods, platform fees) as communicated to you at the time of use.

5. Fees and Commission

Infinite Offers charges a commission or platform fee as described on the Platform (e.g., 1% at closing). The exact terms, including when the fee is payable and any exceptions, will be set out in any separate agreement you enter into with us. You are responsible for any third-party costs (e.g., legal fees, inspections) that you choose to incur.

6. Prohibited Conduct

You may not use the Platform to: (a) violate any applicable Canadian or local law; (b) misrepresent your identity or the property; (c) harass, abuse, or harm others; (d) spam, scrape, or automate access in an unauthorized manner; (e) interfere with the security or operation of the Platform; or (f) use the Platform for any purpose other than its intended use for real estate-related inquiries and transactions. We may suspend or terminate your access if we reasonably believe you have breached these terms.

7. Intellectual Property and Content

The Platform and its content (including text, graphics, logos, and design) are owned by Infinite Offers or its licensors and are protected by Canadian and international intellectual property laws. You may not copy, modify, or distribute our content without permission. You grant us a licence to use any content you submit (e.g., listing details, photos) to operate the Platform and as set out in our Privacy Policy.

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” To the maximum extent permitted by applicable law in Canada, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We are not liable for the conduct of users or third-party vendors, or for the accuracy of listings or bids.

9. Limitation of Liability

To the fullest extent permitted by law, Infinite Offers and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Platform. In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater. Some provinces do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability will be limited to the maximum extent permitted by law.

10. Third-Party Services and Links

The Platform may link to or integrate with third-party services (e.g., lawyers, inspectors). We do not control and are not responsible for their services, terms, or privacy practices. Your use of third-party services is at your own risk and may be subject to their terms and applicable law.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information in accordance with Canadian privacy law (including PIPEDA and applicable provincial laws). By using the Platform, you consent to those practices.

12. Changes to Terms

We may update these Terms of Use from time to time. The “Last updated” date at the top will be revised when we make changes. We encourage you to review these terms periodically. Continued use of the Platform after changes constitutes acceptance of the updated terms, subject to applicable law. If you do not agree to the new terms, you must stop using the Platform.

13. General

These terms constitute the entire agreement between you and Infinite Offers regarding the Platform. If any provision is held invalid, the remaining provisions remain in effect.
